Chapter 101

א חייב בשלמא עביט של מימי רגלים איכא זריקה משתברת אלא צואה מאי זריקה משתברת איכא בצואה לחה
1 he is liable. It is clear [why he is liable if he poured out] a chamber pot of urine because it is a kind of sprinkling which is broken up; but where is there a sprinkling which is broken up with excrement? With moist excrement.
ב לימא כתנאי שחט לה חגב ר' יהודה מחייב וחכמים פוטרים
2 Shall we say [that Rav’s statement] is a matter of dispute between Tannaim: “If one slaughtered a locust to an idol, R. Judah holds him liable, but the sages say he is exempt”?
ג מאי לאו בהא קמיפלגי דמר סבר אמרינן כעין זביחה ומר סבר לא אמרינן כעין זביחה אלא כעין פנים
3 Is this not what they are arguing about: [R. Judah] holds that we say it needs to be like the act of slaughter, whereas the others hold that we do not say that it needs to be like the act of slaughter but rather that it must resemble the ritual within the Temple?
ד לא דכ"ע לא אמרינן כעין זביחה אלא כעין פנים בעינן ושאני חגב הואיל וצוארו דומה לצואר בהמה
4 No, all agree that we do not say that it must be like the act of slaughter rather we require it to resemblance the ritual within the Temple; but it is different with a locust because it has a neck like the neck of an animal.
ה אמר ר"נ אמר רבה בר אבוה אמר רב עבודת כוכבים שעובדין אותה במקל שבר מקל בפניה חייב ונאסרת זרק מקל לפניה חייב ואינה נאסרת
5 אמר ר"נ אמר רבה בר אבוה אמר רב עבודת כוכבים שעובדין אותה במקל שבר מקל בפניה חייב ונאסרת זרק מקל לפניה חייב ואינה נאסרת
ו א"ל רבא לר"נ מאי שנא שבר דהויא ליה כעין זביחה זרק נמי הויא ליה כעין זריקה א"ל בעינן זריקה משתברת וליכא
6 א"ל רבא לר"נ מאי שנא שבר דהויא ליה כעין זביחה זרק נמי הויא ליה כעין זריקה א"ל בעינן זריקה משתברת וליכא
ז אלא מעתה אבני בית מרקוליס במה יאסרו א"ל אף לדידי קשיא לי ושאלתיה לרבה בר אבוה ורבה בר אבוה לחייא בר רב וחייא בר רב לרב וא"ל נעשה כמגדל עבודת כוכבים
7 According to this reasoning, why should the stones [which are thrown before] a shrine of Mercurius be forbidden? He answered him: I, too, had that difficulty and I asked Rabbah b. Abbuha, and Rabbah b. Abbuha asked Hiyya b. Rav and Hiyya b. Rav asked Rav who said to him: [The stone] becomes liks an enlargement of the idol.
ח הניחא למ"ד עבודת כוכבים של עובד כוכבים אסורה מיד אלא למ"ד עד שתעבד תישתרי דהא לא פלחה א"ל כל אחת ואחת נעשית עבודת כוכבים ותקרובת לחברתה
8 This works for the one who holds that the idol of an idolater is prohibited immediately [when he makes it]; but according to the one who holds that [the idol is not prohibited] until it has been worshipped [the stones] should be permitted since it has not been worshipped!
ט א"ה בתרייתא מיהא תשתרי אמר ליה אי ידעת לה זיל שקלה רב אשי אמר כל אחת ואחת נעשית תקרובת לעצמה ותקרובת לחברתה
9 [R. Nahman] said back to [Rava]: Each stone becomes an idolatrous object in itself and also an offering to the one next to it. [Rava asked]: If this is so, the last stone at least should be permitted! [R. Nahman] said to him: If you know [which is the last stone], go and remove it! R. Ashi said: Each stone becomes an offering in itself and an offering to the one next to it.
י תנן מצא בראשו כסות ומעות או כלים הרי אלו מותרין פרכילי ענבים ועטרות של שבלים ויינות שמנים וסלתות וכל דבר שכיוצא בו קרב לגבי מזבח אסור
10 We have taught: If he found on top [of a Mercurius] a garment or coins or utensils, behold these are permitted; but [if he found] grape-clusters, wreaths of grain, wine, oil or fine flour, or anything resembling what is offered upon the altar, it is prohibited.
יא בשלמא יינות שמנים וסלתות איכא כעין פנים ואיכא כעין זריקה משתברת אלא פרכילי ענבים ועטרות של שבלים לא כעין פנים איכא ולא כעין זריקה משתברת איכא
11 This makes sense with regard to wine, oil and fine flour, since they are like what is offered within the Temple and they are also sprinkling which is broken up; but grape-clusters and wreaths of grain are not like what is the Temple and they are not sprinkling which is broken up!
יב אמר רבא אמר עולא כגון שבצרן מתחלה לכך
12 Rava said in the name of Ulla: For instance when he harvested at the outset for an idolatrous purpose.
יג א"ר אבהו א"ר יוחנן מנין לזובח בהמה בעלת מום לעבודת כוכבים שהוא פטור שנאמר (שמות כב, יט) זובח לאלהים יחרם בלתי לה' לבדו לא אסרה תורה אלא כעין פנים
13 R. Abahu said in the name of R. Yohanan: How do we know that one who sacrifices a blemished animal to an idol is exempt? As it is stated, “He that sacrifices to any god, save unto the Lord alone, shall be utterly destroyed” (Exodus 22:19). The Torah prohibits only acts like those done within the Temple.
יד הוי בה רבא במאי אילימא בדוקין שבעין השתא לבני נח חזיא לגבוה בבמה דידהו לעבודת כוכבים מיבעיא
14 Rava questioned: What [sort of blemish]? If I say that it is on the cornea of the eye, since such an animal is fit to be offered by the sons of Noah to God upon their altars, is it even necessary to state that it is fit for an idol!
טו אלא במחוסר אבר וכדרבי אלעזר דאמר ר' אלעזר מנין למחוסר אבר שהוא אסור לבני נח שנאמר (בראשית ו, יט) ומכל החי מכל בשר שנים מכל אמרה תורה הבא בהמה שחיין ראשי אברין שלה
15 Rather he must be referring to an animal missing a limb, and it is in accord with R. Elazar, for R. Elazar said: How do I know that an animal missing a limb is prohibited [as an offering] to the sons of Noah? As it is stated, “And of every living thing of all flesh, two of every kind” “(Genesis 6:19) “of every living thing” the Torah stated, Bring an animal all of whose limbs are living.
טז האי ומכל החי מיבעי ליה למעוטי טריפה (בראשית ז, ג) מלהחיות זרע נפקא
16 But the phrase “of every living thing” is needed to exclude an animal which is trefa! This is derived from the phrase “to keep seed alive” (Genesis 7:3).
יז הניחא למ"ד טריפה אינה יולדת אלא למ"ד טריפה יולדת מאי איכא למימר
17 This makes sense to the one who holds that an animal which is trefa cannot bear offspring; but for the one that holds that a trefa can bear offspring, what is there to say?
יח אמר קרא אתך אתך בדומין לך ודלמא נח גופיה טריפה הוה תמים כתיב ביה
18 The verse states “with you” animals like yourself. Perhaps Noah was himself a trefa!
יט דלמא תמים בדרכיו צדיק כתיב ביה
19 It is written concerning him that he was “without blemish.”
כ דלמא תמים בדרכיו וצדיק במעשיו לא מצית אמרת דנח גופיה טריפה הוה דאי ס"ד נח טריפה הוה א"ל רחמנא דכוותך עייל שלמין לא תעייל
20 Perhaps that means without blemish in his ways.! It is written concerning him that he was righteous. Perhaps it means that he was “without blemish” in his ways and “righteous” in his actions. You cannot possibly say that Noah himself was a trefa, for should you think that he was, would God have said to him, “[Animals] like yourself [which are defective] take [into the Ark] but do not take those which are unblemished!
כא השתא דנפקא מאתך להחיות זרע למה לי אי מאתך ה"א לצוותא בעלמא ואפי' זקן ואפי' סריס קמ"ל להחיות זרע:
21 Now that the words “with you” exclude [the trefa] why do I need the phrase “to keep seed alive”? If [the Torah had only written] “with you” I might have said that the reason [he brought the animals on the ark] was merely for companionship and he could bring even an old or castrated animal; therefore it states, “to keep seed alive.”
כב א"ר אלעזר מנין לשוחט בהמה למרקוליס שהוא חייב שנאמר (ויקרא יז, ז) ולא יזבחו עוד את זבחיהם לשעירים אם אינו ענין לכדרכה דכתיב (דברים יב, ל) איכה יעבדו הגוים האלה את אלהיהם תנהו ענין לשלא כדרכה
22 R. Elazar said: How do I know that if one slaughters an animal to Mercurius he is liable? As it is stated, “And they shall not slaughter their offerings unto the seirim” (Leviticus 12:30). Since this text cannot apply to the matter [of worshipping idols] in their regular way, since it is written, “How do these nations serve their gods” (Deuteronomy 12:30) apply it to the matter [of worshipping idols] in an unusual way.
כג והא להכי הוא דאתא האי מיבעי ליה לכדתניא
23 But does [the verse “and they shall not slaughter…”] come to teach this?
